Overview Of Our Consignment Services
Auction Ink provides a trading card consignment service whereby we sell your trading cards to third party buyers through online platforms, such as Facebook, Youtube, eBay, Whatnot and offline venues such as card shows. When a sale is completed, we charge a fee on the final sales price on each item or groups of items and remit the remaining portion from each sale to you, hereafter known as “Consignment Services”. Below are the terms under which you agree to use our Consignment Services for which good and valuable consideration, the receipt and sufficiency of which the parties hereto both acknowledge:
Ownership
You warrant, certify, and agree that any and all trading cards being sold using our Consignment Services are owned by you and that there are no liens, judgments or other encumbrances against the ownership, including all rights of sale or transfer, of the consigned trading cards. You will retain full ownership of the trading cards until they are either sold in severable parts or in whole by us or disposed of/donated as described below.
Condition of Trading Cards
Trading cards shipped to use should be sleeved and in top loaders or one touches, unless agreed upon by us prior to shipping. Please ensure you package your trading card appropriately. We will notify you if we receive a shipment with damaged cards.
Exclusive Right To Sell
By utilizing our Consignment Services, you grant us an exclusive right to sell your trading cards.
Term Of Agreement
Each shipment we receive from you will be a separate agreement and end when all the trading cards in that shipment are sold, 6 calendar months months have elapsed, or the Consignment Agreement for that shipment has been terminated by either you or us.
Sale of Trading Cards
Unless otherwise requested by you and agreed to by us, the sale of all cards will be as follows:
- Cards will be listed on eBay individually at a 7 day auction with a starting price of 0.99c with no reserve set
- Any card that does not sell at auction will be listed as fixed price listing with a starting price of $5.99 with offers accepted
- Routinely, all fixed price listing will be reduced by $1 until the item sells at 0.99c or 6 months have elapsed.
Unsold Cards
After six (6) calendar months, unless you have requested the return of the remaining cards from a shipment, all remaining cards from that shipment will either be sold as a lot, disposed of, or donated at our sole discretion.
Termination of the Consignment Agreement
You can terminate the Consignment Agreement at any time. Upon termination, any cards that have been listed at auction must be allowed to complete their auction and if sold, will not be returned to you. Any cards that have been prepared for, but not placed at auction, will be assessed a $1 fee per card which must be paid prior to us returning your cards to you. You will be solely responsible for postage for the return shipping.
Reservation Of Rights
We reserve the following rights:
- Not list any trading card(s) that we feel is not authentic or is altered
- Not list any trading card(s) that we feel will not sell for at least 0.99c
- Not list any trading card(s) where uncertainty exists on actual ownership
- End any and all sales of trading cards if we determine, after an investigation or in our sole discretion, that you engaged in shill bidding or other unethical/illegal practices.
Fee Schedule
Fees will be assessed on the sales price of the card only which excludes taxes, shipping fees, handling fees, or any other fee we may charge the buyer of the card(s).
- Cards sold at auction
- 0.99c – $3.50 – 50% of the sales price
- $3.51 – $10.00 – 20% of the sales price +0.75c listing fee
- Cards sold at fixed price
- 0.99c – $3.50 – 50% of the sales price
- $3.51 – $10.00 – 20% of the sales price
- Any card that does not sell at auction will incur a $1 listing fee
- Any card(s) that is received in a shipment and not sleeved or top loaded will incur a 0.20c additional fee (unless previously agreed to by both parties)
Your payout is available for disbursement 3 days after the buyer pays for the card. Levied fees are applied by shipment to you account on a rolling basis. Should your account go negative, we will contact you and request you bring your balance to zero.
